We do not make any guarantees that you will obtain a particular result, professional qualification or employment opportunity from purchasing and using the Products and Services.
You do not need to register for an account with us to purchase Products. You must, however, register for an account with us to access an online course, product or other service accessed digitally.
We do our best to make sure that our inventory numbers are listed as accurately as possible, but sometimes an item listed on the website runs out of stock. We reserve the right to cancel or decline your order or any part of your order at any time, at which time you will receive a refund for any out of stock items.
Following receipt by us of your Order for Products and Services purchased via the Website, on the telephone, via email or in person you will receive an email confirming receipt of your Order. However, please note that this does not mean that your order has been accepted.
We will confirm acceptance of your order forming a Contract by sending you an email that confirms the Goods have been dispatched and/or that a class/course has been booked (Order Confirmation).
A legally binding agreement (Contract) between us and you shall come into existence when we have:
- accepted your offer to purchase Products and Services (Order Confirmation)
- received payment of the relevant Fees from you
If you have purchased a digital gift certificate, we will email your gift certificate to you, or your chosen recipient (using the information you provided during checkout).
We strive to ship your order out as soon as possible.
Delivery of an Order shall be complete when the order has been delivered to the delivery address provided. Occasionally our delivery to you may be affected by an Event Outside Our Control, such as postal service delays. The Products and Services are owned by you once we have received the Fees in full, including delivery charges, and you have received the Order Confirmation email.
Sew Sweetness and its owner, employees, and independent contractors are not responsible for any loss or damages caused by using the products that we sell (both physical products and digital products). Sew Sweetness and its owner, employees, and independent contractors are not responsible for any loss or damages caused by using our advice (presented in digital communication, via video, etc.).
Although Sew Sweetness aims to provide Products and Services to the highest standards of the industry, neither it, nor its owner, employees, or independent contractors accept any liability for:
- any inaccuracy or misleading information provided in the courses or Course Materials and any reliance by the Purchaser on any such information,
- any loss or corruption of data,
- any loss of profit, revenue or goodwill,
- any indirect, special or consequential loss arising from any breach of these Terms and Conditions.
Intellectual Property
All Intellectual Property Rights in all Products and Services (Online Courses, Course Materials, patterns, Products, the speeches made by owner, employees, and independent contractors for In Person and Online Courses and any other Products and Services provided to the Purchaser by Sew Sweetness) are, and remain, the intellectual property of Sew Sweetness, whether adapted, written for or customized for the Purchaser or not.
You are not authorized to:
- copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the Products and Services without prior written permission;
- record on video or audio tape, relay by videophone or other means the Online Courses given
- use the Course Materials in the provision of any other course or training whether given by us or any third-party instructor;
- remove any copyright or other notice of Sew Sweetness on the Products and Services;
- modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Products and Services.
Breach by you of this clause shall allow us to immediately terminate these Terms and Conditions with you and cease to provide you with any Products and Services, including but not limited to access to the Online Courses or other Products and Services.
In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive license to use the Course Materials, complete an Online Course or create an item from a pattern. The license we provide allows you individual access to an Online Course and/or pattern, you may not share an Online Course and/or pattern with another party, whether for profit, or not.
We only supply Products and Services for private use. By agreeing to these Terms and Conditions you accept that you will not use the Products and Services for commercial, business or resale purpose.
